1. Acceptance of Terms

By accessing the Mountain Mulching & Excavation website or engaging our services, you agree to be bound by these Terms of Service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws in Idaho and Wyoming. If you do not agree with any of these terms, you are prohibited from using or accessing this site or our services.

2. Description of Services

Mountain Mulching & Excavation provides professional land management services, including but not limited to: forestry mulching, excavation, land clearing, wildfire fuel reduction, and defensible space work. We operate primarily in the Teton region, serving clients across Idaho and Wyoming with specialized equipment and local expertise.

3. Eligibility and Lawful Use

You must be at least 18 years of age and the legal owner or authorized representative of the property being serviced. Use of our services for any illegal purpose or in violation of local environmental regulations is strictly prohibited. You agree to obtain all necessary permits required for the requested land management work.

4. Estimates, Quotes, and Payment Terms

Estimates provided are based on initial site assessments and are subject to change upon closer inspection or discovery of unforeseen site conditions. Quotes are valid for 30 days. Payment is due upon completion of the service unless otherwise specified in writing. Late payments may be subject to interest charges as permitted by state law.

5. Scheduling, Access, and Site Conditions

Proprietors must provide clear, safe access to the work site for heavy machinery. Mountain Mulching & Excavation is not responsible for delays caused by extreme weather, ground saturation, or restricted access. We reserve the right to reschedule work if site conditions pose a safety risk to operators or equipment.

6. Client Responsibilities

The client is responsible for accurately identifying property boundaries, underground utilities (via 811 location services), irrigation systems, and any hidden hazards. Failure to provide accurate information may result in service interruption and client liability for damages to equipment or property.

7. Phone, Text, and Email Communications

By providing your contact information, you consent to receive service-related communications, including calls, text messages (SMS), and emails. These may include appointment reminders, updates on site conditions, or billing notifications. Use of our dedicated phone number is limited to legitimate business inquiries and service coordination; any misuse or harassment via these channels will result in immediate termination of communication and potential legal action.

8. Acceptable Use and Prohibited Conduct

You agree not to use our website or contact details for illegal activities, harassment, spam, or any form of unauthorized commercial solicitation. We reserve the right to refuse service to any individual who violates these standards of conduct or creates an unsafe working environment for our staff.

9. Safety and Environmental Practices

Mountain Mulching & Excavation prioritizes safety and ecological health. We adhere to local wildfire mitigation guidelines and BMP (Best Management Practices) for erosion control and soil protection. Clients must remain at a safe distance from operating machinery at all times during site work.

10. Service Limitations and No Guarantees

While our wildfire fuel reduction and defensible space work significantly lower fire risks, we provide no guarantee that your property will be immune to wildfire damage or other natural disasters. Land management is a mitigation strategy, not a total prevention solution. We are not responsible for property value fluctuations following land clearing or mulching.

11. Warranties and Disclaimers

Our services are provided 'as is' without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability or fitness for a particular purpose. We do not warrant that results will meet specific aesthetic preferences beyond the agreed-upon scope of work.

12. Limitation of Liability

In no event shall Mountain Mulching & Excavation be liable for any damages (including, without limitation, damages for loss of property use, profit, or data, or due to business interruption) arising out of the use or inability to move equipment on-site, even if we have been notified of the possibility of such damage.

13. Indemnification

You agree to indemnify, defend, and hold harmless Mountain Mulching & Excavation and its employees from any claims, damages, or costs (including legal fees) arising from your breach of these terms or your violation of any law or the rights of a third party regarding the property being serviced.

14. Cancellation and Rescheduling

Cancellations made less than 48 hours before the scheduled service date may be subject to a cancellation fee. We strive to be flexible but maintain schedules to ensure service for all regional clients. Deposits, where required, are non-refundable unless we are unable to fulfill the service for reasons under our control.

15. Changes to Terms

Mountain Mulching & Excavation may revise these Terms of Service for its website and services at any time without notice. By using this website or our services, you are agreeing to be bound by the then-current version of these Terms of Service.

16. Governing Law and Venue

These terms and conditions are governed by and construed in accordance with the laws of Idaho and Wyoming, as applicable to the location of service, and you irrevocably submit to the exclusive jurisdiction of the courts in those States or locations.
